2. Purpose of Processing

At Australis Solutions S.L. we process the information provided by interested parties for the following purposes:

  • Managing table reservations through the DISH Reservation platform.
  • Handling enquiries, requests and information petitions received by email, phone or WhatsApp.
  • Providing restaurant and pastry services (Ocampo Bakes).
  • Managing home delivery orders through external platforms (Uber Eats).
  • Sending commercial communications, provided the user has given express consent.
  • Complying with current legal obligations (tax, health, etc.).

3. Lawful Basis

The legal basis for processing your data is:

  • Consent of the data subject: for sending commercial communications and managing non-essential cookies.
  • Performance of a contract: for reservation management and provision of restaurant services.
  • Legitimate interest: to respond to enquiries and improve our services.
  • Compliance with legal obligations (tax, health, accounting).

4. Data Retention

Personal data will be kept for the time necessary to fulfill the purpose for which it was collected and to determine possible liabilities derived from said purpose. Specifically:

  • Reservations: up to 1 year after the last visit, unless a different legal obligation applies.
  • Enquiries and WhatsApp: up to 2 years after the last communication.
  • Tax and accounting data: 6 years (art. 30 Commercial Code).
  • Consents: until they are revoked.

5. Recipients and Third-Party Transfers

Your personal data will not be transferred or sold to third parties for commercial purposes. However, for the correct provision of the service, some data may be processed by technology providers and external platforms as data processors or independent controllers:

5.1. DISH Reservation (booking management)

The reservation form integrated on our website is operated by DISH Digital Solutions GmbH (a subsidiary of METRO AG), based in Germany. The data entered (name, phone, email, date and number of guests) are processed by DISH to manage the reservation. More information in the DISH privacy policy.

5.2. WhatsApp (messaging)

Our website includes a WhatsApp contact button which, when clicked, redirects the user to the WhatsApp application operated by WhatsApp Ireland Limited (Meta Platforms, Inc. group). Messages and data exchanged from that moment are subject to the WhatsApp privacy policy. Australis Solutions S.L. is not responsible for WhatsApp's processing of such data, although it does keep messages received for customer service purposes.

5.3. Uber Eats (home delivery)

Our website includes a direct link to our Uber Eats profile, operated by Uber B.V. (Netherlands). By clicking, the user leaves our website and accesses an external platform whose data processing is the exclusive responsibility of Uber. Consult the Uber privacy policy.

5.4. Google Maps (location)

The restaurant's location is shown via an embedded map from Google Ireland Limited. When viewing this website, Google may collect technical data (IP, browser, etc.). More information in the Google privacy policy.

5.5. Other Mandatory Disclosures

Your data may be communicated to competent authorities (Tax Agency, courts, Social Security, etc.) when there is a legal obligation.

5.6. International Transfers

Some of the providers mentioned (Meta, Google, Uber) may process data outside the European Economic Area. These transfers are protected by Standard Contractual Clauses approved by the European Commission, guaranteeing an adequate level of protection in accordance with art. 46 GDPR.

Anyone has the right to obtain confirmation as to whether Australis Solutions S.L. is processing personal data concerning them. Interested persons have the right to:

Australis Solutions S.L. adopts the technical and organizational measures necessary to guarantee the security of personal data and prevent its alteration, loss, unauthorized processing or access, in accordance with art. 32 GDPR.

The services offered through this website are aimed at persons over 14 years of age. Minors under this age must not provide personal data without the express consent of their parents or legal guardians, in accordance with art. 7 LOPDGDD.
